  • Acceptance of Terms By submitting your information through OBIO’s online form, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.  

  • Purpose of Data Submission: The data you provide through this form will be collected and used by OBIO® to assess your eligibility for OBIO® program offerings and/or assess industry trends and inform our service offerings and advocacy efforts on behalf of the life science sector. Your contact information may be used for marketing and outreach purposes by OBIO®. Your data will not be used for any other purposes without your explicit consent. 

  • Data Use and Sharing: The data collected through this form will be used exclusively for the purposes outlined above. We may share your data with government funding agencies, when it is required for us to do so, for the same purposes. We will not sell, rent, or lease your organization data to third parties without your explicit consent. Company logo submitted through online forms may be used on OBIO® marketing materials (e.g. website, directory, etc.) 

  • OBIO® Program Funding Decisions: Data submission does not guarantee funding or acceptance into OBIO’s programing. For funding eligibility, the Company must adhere to the additional criteria set by the OBIO® program teams and engage in the application procedure required by the individual program. OBIO® membership may be a requirement for some of OBIO’s program offerings. If accepted to an OBIO® funded program, a Project Agreement will be enacted to delineate the project obligations of each party. Any Project Agreement entered into with OBIO® will have distinct Terms and Conditions specific to the Project Agreement.  

  • Data Collected: We may collect various types of information, including but not limited to: 

  • Organization Identification Information (e.g., name, email address, phone number, logo) 

  • Organization Demographic Information (e.g., organization sector, organization size, product type, etc) 

  • Other relevant information (e.g., preferences, interests, feedback) 

  • Consent to Data Collection: By submitting your information, you consent to our collection, use, and processing of the data you provide in accordance with these Terms and Conditions. 

  • Data Accuracy: You agree to provide accurate, complete, and up-to-date information. Providing false or misleading information may result in your submission being rejected or your account being suspended or terminated. 

  • Data Security: We implement appropriate technical and organizational measures to protect your data from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security. 

  • Data Retention: We will retain your data for as long as necessary to fulfill the purposes for which it was collected or as required by law.  

  • Your Rights You have the right to: 

  • Access the organization data we hold about you; 

  • Request the correction or deletion of your data; 

  • Withdraw your consent to being contacted for marketing or outreach purposes; 

  • Lodge a complaint with a data protection authority if you believe your rights have been violated

  • Limitation of Liability for Data Submission: To the fullest extent permitted by law, OBIO® shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with your submission of data through our website or online forms, including but not limited to: 

  • Any loss of data, unauthorized access to your data, or alterations made to your data due to factors beyond our reasonable control, such as technical failures, cyber-attacks, or security breaches; 

  • Any errors, omissions, or inaccuracies in the data you submit, or the consequences of providing incorrect, incomplete, or misleading data;  

  • Any interruption, suspension, or termination of your ability to submit data due to system errors, maintenance, or other unforeseen circumstances;  

By submitting your data, you agree that OBIO® is not responsible for any damages or losses resulting from the submission or use of your data. You also acknowledge that you submit your data at your own risk and that OBIO® does not guarantee the security or confidentiality of the data submitted. 


OBIO® Membership Terms and Conditions

Welcome to OBIO®. By registering as a member, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before proceeding with your registration. 

1 - Acceptance of Terms  

  • By registering as a member, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. 

2 - Membership Eligibility 

  • Membership is open to organizations who support the mission and objectives of OBIO® 

  • Membership is subject to approval by OBIO®, and the organization reserves the right to refuse or terminate membership at its discretion. 

  • Members who meet the eligibility requirements and have paid in full are entitled to Member benefits

3 - Membership Categories 

  • OBIO® offers the following types of memberships: 

  • Early-Stage Company: small-medium enterprises commercializing products and services in therapeutics, medical devices, diagnostics, digital health and health IT 

  • Investors: venture fund investors, angel investors and family offices who invest in life sciences and health tech companies 

  • Academic, Government and Not-for-Profit: academic institutions (excluding tech transfer offices), government ministries or agencies and not-for-profit organizations 

  • Commercial Pharma & MedTech: companies with commercial presence in multiple countries 

  • Umbrella Members: tech transfer offices, accelerator and incubator programs that support startup companies and want to access OBIO® services for their startups 

  • Service Providers: companies offering services to early-stage companies including but not limited to legal, consulting, banking, contract research, contract manufacturing and product development services 

  • Each category of membership may have different rights, benefits, and fees. Please refer to the Membership Page on the OBIO® website for further details 

  • Members must select the appropriate membership type during the registration process. 

4 - Registration Process 

  • Members must complete the registration form accurately and completely. 

  • Membership becomes active only upon payment of the applicable membership fee and confirmation from OBIO®. 

  • Members will receive a confirmation email with their membership details upon successful registration. 

5 - Membership Term 

  • Membership is valid for one calendar year following the date that Membership payment is received

  • Members that do not renew their membership on or by their Membership anniversary date will lose access to the Member Portal and Member benefits after a 7-day grace period

6 - Membership Fees

  • Membership fees are payable at the time of registration and annually thereafter 

  • Current Membership fees are posted on the Membership Page of the OBIO® website 

  • Membership fees may be paid via credit card or electronic funds transfer (EFT). 

  • All fees are non-refundable unless otherwise specified in these terms.

7 - Changes to Membership Fees

  • OBIO® reserves the right to change the membership fees at any time. Members will be notified of any fee changes at least 30 days in advance of the change taking effect. New fees will be applied at the time of your next annual renewal. 

  • If a member does not agree with the fee change, they may cancel their membership before their next renewal date.

8 - Renewal and Cancellation 

  • Memberships automatically renew on the anniversary of the registration date unless canceled by the member. 

  • Members will receive reminders of their upcoming renewal starting 60 days before the renewal date. 

  • Members can cancel their membership renewal at any time by updating their profile in the Member Portal or by providing written notice to OBIO® at membership@obio.ca. Cancellations must be made 5 business days before the renewal date to avoid being charged for the next term.  

  • No refunds will be issued for cancellations made after the renewal date. 

9 - Member Benefits and Obligations 

  • Member benefits and services are subject to change. An overview of Member benefits is available on the Membership Page of the OBIO® website. Member benefits are accessible to Members through the Member Portal 

  • Members are expected to: 

  • Adhere to the code of conduct and any rules, regulations or policies set forth by OBIO®. 

  • Keep their contact information up to date. 

  • Pay their membership fees on time. 

  • Support the mission, vision, and values of OBIO® 

  • Act in a manner that is respectful and non-disruptive to the organization and other members. 

  • Avoid actions that may damage the reputation of OBIO®. 

10 - Code of Conduct 

  • Members are expected to act respectfully and professionally in all interactions with OBIO® and other members. 

  • Any violation of the code of conduct may result in the suspension or termination of membership without a refund.

11 - Data Use 

  • OBIO® will collect and use member data for membership administration and communication purposes and in accordance with our Data Collection Terms and Conditions, which are available for review on the OBIO® webpage. OBIO® will not share member information with third parties without consent. 

  • Members consent to the use of their images or videos taken at OBIO® events, and testimonials for promotional purposes by OBIO®, unless they explicitly opt out.

12 - Termination of Membership 

  • OBIO® reserves the right to terminate a membership at any time for violations of these terms and conditions or other serious misconduct. 

  • Terminated members will not be entitled to a refund of any membership fees paid.

13 - Liability 

  • OBIO® is not liable for any losses, damages, or injuries that occur during the course of membership, except in cases of gross negligence or willful misconduct. 

  • Members participate in activities at their own risk. 


General

Changes to Terms and Conditions: We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions. 

  • Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of Ontario, and you hereby submit to the exclusive jurisdiction of the courts in that jurisdiction. 

  • Indemnity: You agree to indemnify and hold harmless OBIO®, its affiliates, and employees from any claims, damages, losses, liabilities, or expenses arising out of your use of the website or submission of data through online form, your violation of these Terms and Conditions, or any breach of applicable laws.
